Terms of Service

By accessing or using Xitoring's monitoring platform, website, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Xitoring provides infrastructure monitoring services including, but not limited to, server monitoring, uptime monitoring, SSL certificate monitoring, API monitoring, heartbeat monitoring, cronjob monitoring, and status pages.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

You must provide accurate and complete registration information and keep your account credentials secure.

You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You must be at least 16 years old to create an account.

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable unless otherwise stated.

We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

Free tier accounts are subject to usage limits as described on our pricing page. We reserve the right to modify free tier limits.

You agree not to:

Use the Services for any unlawful purpose or to violate any laws.

Attempt to probe, scan, or test the vulnerability of our systems.

Interfere with or disrupt the Services or servers connected to the Services.

Use the Services to monitor resources you do not own or have authorization to monitor.

Resell or redistribute the Services without our written consent.

Use automated tools to scrape, crawl, or extract data from the Services beyond normal API usage.

Your Data: You retain all rights to the data you submit to the Services. You grant us a limited license to process your data solely to provide the Services.

Our Platform: The Services, including all software, designs, and documentation, are owned by Xitoring and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Services.

Xitoring targets 99.9% uptime for its monitoring platform. Specific SLA terms, including service credits for downtime, are detailed in our SLA document available upon request.

Scheduled maintenance windows are excluded from uptime calculations. We will provide advance notice for planned maintenance.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XITORING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Xitoring, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

Either party may terminate these Terms at any time. You may cancel your account through the dashboard or by contacting support.

We may suspend or terminate your access if you violate these Terms, with notice where practicable.

Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days to allow for export, after which it will be deleted.

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in San Francisco, California, except for claims seeking injunctive relief.

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website. Continued use after changes constitutes acceptance.
